LIMITATION OF THE RIGHT TO FREEDOM OF CREATIVITY IN PRECEDENTIAL PRACTICE OF THE EUROPEAN COURT OF HUMAN RIGHTS

Annotation

The article analyzes the decisions of the European Court of Human Rights on violations of Article 10 of the Convention on the Limitation of the Freedom of Creation. Freedom of creative expression is revealed as an element of freedom to receive and disseminate ideas, to participate in the exchange of cultural, political and social information and ideas. It is proved that the modern European legal tradition of freedom of creativity is closely bound up with restrictions, provided that the need for them must be proved with a high degree of their legitimacy, proportionality and expediency.

It has been determined that in the limitation of the right to freedom of creation for the protection of the health or morals of others, the ECtHR practice recognizes the broad discretion of States. When deciding the question of the boundaries of state intervention in order to protect public morality, the Court proceeds from the absence of a united, consistent international concept of "social morality". The boundaries of freedom of creativity are established by the states in accordance with the norms of social ethics and morals. Relevant restrictions on the freedom of creativity are considered legitimate if they are aimed at preventing neglect of the feelings of national minorities or believers, to protect the most vulnerable categories of the audience (children), etc.

It has been determined that in decisions regarding the restriction of the right to freedom of creation in order to protect the reputation or rights of others, the ECHR indicates that the creators are immune to the possible restrictions defined in article 10, paragraph 2 of the Convention, and the person exercising the freedom to express his creative thinking takes to himself in accordance with the conditions established in the above paragraph, obligations and responsibilities. In cases where the content of creativity is about libel, the humiliation of the honor and dignity of the individual, the ECtHR supports proportional government intervention in the exercise of the right to freedom of creativity
